Any reproduction, repetition, use or adaptation, in any manner whatsoever, of all or part of the Website, including its technical applications, is strictly prohibited without the Controller’s prior written permission.

If the Controller does not immediately take action against any infringement, this may not be interpreted as tacit permission or as a waiver of the right to take legal action.

Article 4 – Management of the Website

For the proper management of the Website, the Controller may at any time:

  • Suspend, interrupt or restrict access to the entire Website or to part of it for a particular category of visitors;

The Controller shall not be liable under any circumstances for failures, malfunctions, difficulties or interruptions in the operation of the Website that result in the Website or any of its functionalities becoming inaccessible. The manner in which you connect to the Website is your own responsibility.

You must take all appropriate measures yourself to protect your equipment and data against, among other things, virus attacks on the internet. You are also responsible for the websites you visit and the data you access on the internet.

The Controller shall not be liable for any legal proceedings brought against you:

  • As a result of your use of the Website or services accessible via the internet;

If the Controller becomes involved in a dispute as a result of your use of this Website, the Controller shall be entitled to recover from you all losses incurred or to be incurred as a result of that dispute.

Article 6 – Collection of Data

Your data is collected by Van der Sneppen BV and one or more external processors. Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or one or more elements specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

The personal data collected on the Website is primarily used by the Controller to maintain relationships with you and, where applicable, to process your orders.

Article 7 – Your Rights Regarding Your Data

Pursuant to Article 13(2)(b) of the General Data Protection Regulation (GDPR), everyone has the right to access and rectify or erase their personal data, or to restrict the processing of their personal data. You also have the right to object to the processing of your personal data and the right to data portability.

You may exercise these rights by contacting us at contact@vivelino.com.

To ensure that the request was made by you, we may ask you to verify your identity, for example by using the email address with which you placed orders with us.

If, in exceptional cases, we ask you to provide a copy of your identity document, we recommend that you redact your photograph, the machine-readable zone (MRZ—the strip containing numbers at the bottom of your passport), your passport number and your Citizen Service Number (BSN) in that copy, in order to protect your privacy.

You will receive a response to your request within one month of its submission. Depending on the complexity and number of requests, this period may, if necessary, be extended by up to two additional months.

Article 8 – Processing of Personal Data

If a visitor is suspected of violating any law or regulation and the authorities require personal data collected by the Controller for that purpose, the data will be provided to those authorities following an explicit and reasoned request. Once provided, this personal data will no longer be subject to the protection afforded by the provisions of this Privacy Policy.

If certain information is required to access specific functionalities of the Website, the Controller will indicate that providing this information is mandatory when the data is requested.

Article 9 – Commercial Offers

You may receive commercial offers from the Controller. If you no longer wish to receive such offers, please send an email to contact@vivelino.com.

If you encounter personal data belonging to other individuals while visiting the Website, you must refrain from collecting or otherwise using that data without authorisation, as well as from taking any action that infringes the privacy of those individuals. The Controller shall not be liable under any circumstances for the situations described above.
